Website Terms of Use
These Terms set out the conditions for using the website megatech.co.th (the “Site”), operated by MEGA TECH (THAI) CO., LTD. (the “Company”). By using the Site you are deemed to have accepted these Terms. Use of the bidding (auction) service is governed separately by the Auction Service Terms of Use.
1. Scope
These Terms apply to all use of the Site, including browsing, enquiries and requests for information. Where separate terms or conditions are established for a specific service, those terms prevail over these Terms.
2. Information published on the Site
The Company takes reasonable care to ensure the accuracy of information published on the Site but does not warrant that it is complete or current. Stock availability, specifications and prices of used machinery may change without notice, or the item may already have been sold.
- Stock information reflects the position at the time of publication and an item may already be sold when you enquire.
- Year of manufacture, capacity, tonnage and similar details are reference information taken from manufacturer documentation or the machine nameplate, and are not a warranty of the actual condition of the machine.
- Unless stated otherwise, prices are in Thai Baht, exclusive of VAT, and on an ex-warehouse basis at the Company's premises.
- Photographs differ from machine to machine. Please confirm the presence of accessories on a case-by-case basis.
3. Intellectual property
Copyright and all other intellectual property rights in the text, photographs, drawings, video, logos and all other content on the Site belong to the Company or to the respective rights holders. Reproduction, republication, modification or redistribution beyond the scope of private use is prohibited without the Company's prior written consent.
4. Prohibited conduct
The following conduct is prohibited when using the Site.
- Conduct that violates any law or public order and morals.
- Conduct that infringes the rights of the Company, other users or third parties.
- Submitting enquiries or registrations using false information.
- Excessive automated access, unauthorised access, vulnerability probing or any other conduct that interferes with the operation of the Site.
- Collecting or using information on the Site for commercial purposes without the Company's prior consent.
5. Links
Linking to the Site is generally permitted. However, the Company declines links from sites containing defamatory content about the Company or content contrary to public order and morals. Links from the Site to external sites are provided for convenience, and the Company accepts no responsibility for the content of linked sites.
6. Disclaimer
The Company is not liable for any damage arising from the use of, or inability to use, the Site, except where such damage results from the Company's wilful misconduct or gross negligence. The same applies to any interruption or suspension of the Site caused by network or system failure, force majeure or any other cause beyond the Company's reasonable control.
7. Personal data
The handling of personal data provided through enquiries or otherwise is governed by the separately published Privacy Policy.
8. Amendments
The Company may amend these Terms where it considers it necessary. Amended Terms take effect from the time they are published on the Site.
9. Governing law and jurisdiction
These Terms are governed by and construed in accordance with the laws of the Kingdom of Thailand. Any dispute between the Company and a user concerning the Site shall be submitted to the exclusive jurisdiction, in the first instance, of the Thai court having jurisdiction over the location of the Company's head office.
10. Language
These Terms are provided in Thai, Japanese and English. In the event of any discrepancy in interpretation between the versions, the Thai version prevails.
